Veteran's Benefits- What You Need To Know!

As an accredited attorney for the US Veteran's Administration, I work with many veterans and families to assist in obtaining a wide variety of VA benefits. While there are well over 10,000 attorneys in the state of Alabama, only a couple of hundred or so have been accredited with the VA, so before you walk away from a veteran's benefit, be sure that whoever is advising you knows what they are talking about.

While the VA offers a wide range of medical and healthcare benefits, burial benefits and of course, educational and home loan benefits, the one that seems to get the most attention is the one people call "Aid and Attendance" , sometimes called "Aid and Assistance" but never called by its real name, the "Improved Pension Benefit". Whatever you call it, this benefit will pay an eligible married veteran up to $2,120 per month in tax-free installments that are direct-deposited to his checking account. For unmarried vets the monthly installment is $1,788.

Probate! What is it anyway?

Probate- the word confounds many people. They have heard that probate is something to avoid at all costs, like poison ivy or salmonella. They have heard speakers rail about probate in seminars and on TV, but they only have a vague notion about what exactly probate really is. Let's fix that, shall we?

Probate is a term used to describe a process that controls how a person's estate (his or her stuff) passes after death to family, friends and charity. It is important to note that each state handles the process differently, so I am only talking about Probate in Alabama here.

2nd Marriage? Better Read This!

Couples who choose to marry a second time usually enter the covenant of marriage with a completely different perspective than they had on that first go-round. If each partner has children from the previous marriage(s), they have a built-in conflict brewing even if they don't realize it. Your new spouse may love you but he (or she) is most likely more devoted to his or her own children than to the ones you brought with you. It is difficult for families to acknowledge this fact, and yet, if you died first, it is very likely that her children will come out better than your children. That is, unless you take the time to sit down with an Estate-planning attorney to review all of the possibilities.

OVER 65? Been Denied for Long-Term Care Insurance?

Over 65?

THERE IS A “PLAN B”! If you are concerned about the devastating costs of long-term care and do not have long-term care insurance, you owe it to yourself to learn your options.

For those who cannot qualify or for budget reasons choose not to apply, PLAN B is the best option for them. PLAN B, if put in place soon enough, will protect a family’s life-savings from the devastating costs of long-term care!

Statistics say that 50% of us over age 65 will spend time in a skilled care facility where the costs are over $7,000 per month! This expense is not covered by Medicare, TriCare or Blue Cross. Don’t kid yourself- you or your spouse might have to move there, despite your wishes to the contrary! How will you pay for this without a plan? That is where PLAN B comes into action.

The average stay in a nursing home can exceed 3 years.

Protecting The Assets Of The Deceased

In order to enforce and carry out the intentions of a testator, or the person who created the will, the will must go through the time-consuming and often complicated probate process.   Probate is where property is dispersed to other individuals by a Probate Court.  If you have an interest under the will, you may submit the will to probate, generally, within a five-year limitation from the testator’s death.

Elder Law & Age Discrimination

Many senior citizens cannot afford to retire.  Even when they do, the elderly may need to still maintain part-time employment to supplement their income or other benefits.  However, their income is usually never as high as it was while being employed full-time.

This issue is particularly tough since elders often face
